Abstract

Abstract

The rise of sexual violence against minors, especially child abuse, needs serious attention because it has a negative impact on the psychology and development of children. Therefore, the law must better protect minors who are involved in sexual violence or who witness such criminal acts to create a safe environment for children. Protection from ill-treatment is a child's right that must be upheld. All of this must be in line with the rules set out in the Child Protection Law Number 35 of 2014. Sexual violence that occurs in many communities, including in South Bolaang Mongondow Regency, requires serious attention, but the implementation of this protection is still not optimal. This research aims to identify legal protection for child victims of sexual violence. The research method used is normative research with a descriptive approach to principles, laws and regulations, and legal concepts. This research is expected to provide a deeper understanding of legal protection to prevent sexual violence against children.

Abstrak

Maraknya tindak kekerasan seksual terhadap anak di bawah umur khususnya pencabulan terhadap anak, perlu mendapatkan perhatian serius karena berdampak negatif terhadap psikologi dan tumbuh kembang anak. Oleh karena itu, hukum harus lebih melindungi anak di bawah umur yang terlibat dalam tindak kekerasan seksual atau yang menyaksikan tindak pidana tersebut untuk menciptakan lingkungan yang aman bagi anak-anak. Perlindungan dari perlakuan buruk merupakan hak anak yang harus dijunjung tinggi. Semua ini harus sejalan dengan aturan yang ditetapkan dalam Undang-undang Perlindungan Anak Nomor 35 Tahun 2014. Kekerasan seksual yang banyak terjadi di masyarakat, termasuk di Kabupaten Bolaang Mongondow Selatan memerlukan perhatian serius, akan tetapi implementasi perlindungan tersebut masih belum maksimal. Penelitian ini bertujuan untuk mengidentifikasi perlindungan hukum terhadap anak korban kekerasan seksual. Metode penelitian yang digunakan adalah penelitian normatif dengan pendekatan deskriptif terhadap asas, peraturan perundang-undangan, dan konsep hukum. Penelitian ini diharapkan dapat memberikan pemahaman yang lebih mendalam mengenai perlindungan hukum untuk mencegah kekerasan seksual terhadap anak.
